1.Information clause for job applicants

 

Information clause for job applicants under the contract of employment and civil-law contracts

Pursuant to Article 13 sections 1 and 2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as GDPR), we wish to inform you that:

  3. Your personal data will be processed for the purpose of the recruitment process:
  1. for contracts of employment, on the basis of legal obligation of the controller (Article 6 section 1 letter c of GDPR) arising from Article 221 of the Labour Code and your consent (Article 6 section 1 letter a of GDPR) to the processing of data exceeding the catalogue set forth in the Labour Code.
  2. for civil-law contracts, on the basis of contract performance and undertaking of pre-contractual actions (Article 6 section 1 letter b of GDPR) and your consent (Article 6 section 1 letter a of GDPR).

The consent is given by way of clear confirmation action involving the inclusion of additional data that are not required in the recruitment process in the recruitment documents and sending them to the controller.

Your personal data may be processed for the purposes of future recruitment processes if you give a separate consent to their use in subsequent recruitment processes, or if the Controller is not conducting a recruitment process for any specific position and you send your application to the Controller. Then the processing takes place on the basis of Article 6 section 1 letter a of GDPR: the consent is given by way of clear confirmation action involving the sending of recruitment documents to the controller or the provision to it of the contents of the consent (e.g. by including it in the CV, sending it via email or signing a consent document).

Your data may be processed in order to assert claims and defend against claims on the basis of the premise of legitimate interest of the controller under Article 6 section 1 letter f of GDPR.

  1. Your personal data will be transferred to the email hosting provider, recruitment portals, company providing IT services, Poczta Polska S.A. [Polish Post Office], Poviat Labour Offices, other entities, as provided for in the law.
  1. Your personal data will not be transferred to third countries.
  2. Personal data will be processed till the end of the recruitment process or till the consent is revoked. If you give your consent for the purposes of future recruitment processes, your data will be processed till the consent is revoked, but not longer than 6 months. The period of personal data processing may be extended if the processing is necessary for the purpose of determination, assertion of possible claims or defence against them until they become overdue.
  3. You have the right to access the contents of your data, the right to rectification, erasure, restriction of processing and portability of your data, the right to withdraw the consent at any time, without any impact on the legal compliance of processing performed on the basis of consent prior to its withdrawal, and the right to object to processing.
  4. The provision of your personal data is voluntary but necessary to take part in the recruitment process.
  5. You have the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warszawa) if you consider that the processing of your personal data violates the provisions of the law.
  6. Your data will not be subject to profiling and automated decision-making.

 

2.Clause for Contractors and representatives of Contractors

 

Clause for Contractors and persons acting as members of authorities of legal persons, proxies, attorneys, representatives and contact persons for the Contractor

Pursuant to Article 13 sections 1 and 2 and Article 14 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as GDPR), we wish to inform you that:

  1. The Controller of your personal data is Fenzi Polska Sp. z o.o. (limited liability company), ul. Katowicka 23a, 43-600 Jaworzno, (KRS [National Court Register]: 0000162860, NIP [Tax ID No.]: 6321578295, REGON [Statistical No.]: 008062294).

  3. If you are our Contractor, a party to the agreement binding to us:
  • we process your data for the purposes of:

A/ performing the agreement and undertaking actions at the request of data subject before the conclusion of the agreement in accordance with the provision of Article 6 section 1 letter b of GDPR;

B/ performing legal obligations of the controller related, for example, to the financial and accounting settlement on the basis of Article 6 section 1 letter c of GDPR;

C/ asserting claims on the basis of the performance of legitimate interest of the Company under Article 6 section 1 letter f of GDPR;

D/ maintaining business relations on the basis of legitimate interest of the controller under Article 6 section 1 letter f of GDPR;

  • the provision of personal data is necessary for the conclusion and performance of the agreement.

If you are a representative of our Contractor (member of the authorities of a legal person, proxy, attorney, representative or contact person for our Contractor):

  • we process your data for the purposes of:

A/ establishing business relations, including signing agreements, or for the purposes of contacts in relation to the performance of the agreement on the basis of Article 6 section 1 letter f of GDPR;

B/ asserting claims and defending against claims on the basis of Article 6 section 1 letter f of GDPR;

C/ performing legal obligations of the controller related, for example, to the financial and accounting settlement on the basis of Article 6 section 1 letter c of GDPR.

  • We obtained your personal data:

– if you are a person representing the company – from the entity in which you act as a member of authorities of legal persons and from KRS (National Court Register),

– if you are a person appointed for contact by the entity: from the entity in which you perform this function under the performed agreement.

  1. Your personal data will be transferred to the hosting providers, software providers, company providing IT services, offices, banks, Poczta Polska S.A. [Polish Post Office], courier companies, law offices, counselling companies and other entities, as provided for in the law.
  2. Your personal data will not be transferred to third countries.
  3. Your personal data will be processed throughout the term of the agreement and later until the lapse of the limitation period arising therefrom. The data from the financial documents will be processed for a period of time arising from the provisions of the accounting law.
  4. You have the right to access your data and to rectify them, restrict their processing, the right to portability and erasure of data, and the right to object against the processing.
  5. You have the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warszawa) if you consider that the processing of your personal data violates the provisions of the law.
  6. Your data will not be subject to profiling and automated decision-making.

  5. Your personal data will not be transferred to third countries.
  6. Your personal data will be processed until the consent is revoked, but not longer than for two years.
  7. You have the right to access the contents of your data, and the right to rectification, erasure, restriction of processing and portability of your data, and the right to withdraw consent at any time.
  8. The provision of your data is voluntary but necessary to send the query via the contact form.
  9. You have the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warszawa) if you consider that the processing of your personal data violates the provisions of the law.
